Right to Rent

Landlords in England must check that a tenant or lodger can legally rent their property

What is Right to Rent?

Landlords are required to check all tenants' immigration status before granting a tenancy agreement in England.

Who has the Right to Rent?

You have a right to rent if:

  • You are an EEA/Swiss national or family member of an EEA/Swiss national with status granted under the EU Settlement Scheme
  • You have valid immigration permission to be in the UK (Tier 4 student, Student, Dependant, Start-up, Graduate, Short-term Student etc.)
  • You do not have valid immigration permission to be in the UK but have been granted permission to rent by the UK government

Valid immigration permission means your visa has not expired!

What do you need to do?

  • As a tenant you do not need to do anything, it is your landlord's responsibility to check
  • You must provide original evidence to your landlord to prove your immigration status or a share code
  • If you have limited immigration permission, your landlord must check your immigration permission again after 12 months or before your immigration permission expires, whichever is later
  • If you are staying in University accommodation you are exempt from the Right to Rent check

What documents can you show?

  • Passport
  • Online digital status with share code
  • EEA family member BRP
  • Current passport and valid visa/BRP card
  • If your documents are with the Home Office you should provide your landlord with your Home Office reference number so they can carry out a Right to Rent check

The University of Hertfordshire is not able to confirm a student's right to rent with their landlord.
